Cases Seeking Damages

In North Carolina, cases seeking damages under $10,000.00 are filed in District Court. They are required to undergo arbitration. This is a mini one hour hearing that occurs in front of a certified arbitrator, who is a lawyer of the local bar. The arbitrator then makes a written decision of an award in favor of one of the parties, and the same can either become binding, can be appealed by either party, or can be used for further negotiations.

Cases seeking damages over $10,000.00 are filed in Superior Court. These cases are required to undergo mandatory mediation. Mediation is when you attend with your lawyer and the insurance company’s lawyer is usually there with a representative of the insurance company. The named defendant will usually not be there. The mediator attempts to bring the parties to a number that both parties can live with to resolve the claim.
